A pensioner from Liechtenstein harassed other passengers in a bus.
He exposed his penis in front of a man.
The accused was convicted.
The man in front of whom the pensioner is said to have lowered his pants also testified at the trial.
A man from the Principality of Liechtenstein insulted two other passengers in a public bus in August 2020. Then he let his pants down in front of one of them. Then the pensioner is said to have “waved around” his limb for seconds, reports the Liechtenstein newspaper “Vaterland”. The mid-60s stood in front of the regional court on Tuesday. He was charged with discrimination, exhibitionism and sexual harassment. He confessed to the discrimination. He dismissed the other two allegations. Because of a prostate operation, his genitals resemble a “stub”, so he would have only made a fool of himself by exposing himself, the man said.
Nevertheless, he could not completely rule out in court that he had not exposed his penis after all. The pensioner was heavily drunk that day, writes the newspaper. Two witnesses made identical statements that incriminate the pensioner regarding the exposure of his member. The judge found the man guilty.
Responsible or not?
During the hearing, it had to be assessed whether the pensioner is guilty of guilt or should be admitted to an institution for lawbreakers in need of weaning. The public prosecutor’s office asked to be admitted to such an institution. The accused himself said: “I find that blatant and not justified.” He doesn’t feel mentally ill. However, an expert report confirms that he has bipolar affective disorder.
In addition, the man has been suffering from alcohol addiction since 2019. The accused also contradicted this. “I have no problem at all with alcohol. I don’t drink hard things, just an occasional beer, ”he said in court.
Bipolar affective disorder, well-established abbreviation for bipolar disorder, is a mental illness that is one of the mood disorders. The disease is manifested by opposing (bipolar) fluctuations affecting mood, drive, or activity level. The consequences of the disease occur in phases. Those affected fluctuate back and forth between depression and mania – without being able to control these changes. Depending on its course, the disorder can be treated and stabilized if it is recognized early on.
His defense and the trustee responsible for the pensioner spoke out in favor of outpatient therapy. The judge finally gives the pensioner one last chance. The admission to an institution for lawbreakers in need of weaning and a three-month prison sentence were conditionally pronounced.
“Mental imbalance” in the victim
The man before whom the accused is said to have exposed his member also spoke in court. The incident brought him into a “mental imbalance”. «I think about it a lot and also dream about it. Because of this incident, I no longer dare to go for a walk alone », he had an interpreter translate. His private plaintiff demanded damages of around 8,100 francs. In this regard, the judge referred to the civil law route.
